based on theft document can be canceled
Rafale Deal Raphael has got a new turn in the deal deal.
During the hearing in the Supreme Court on Wednesday, the AG presented to the
Central Government said that some of Rafael's papers were stolen from the
Defense Ministry.
There was a hearing again in the Supreme Court regarding the
alleged scam in the Raphael Aircraft deal. A new twist has come in this matter,
during the hearing on Wednesday, the Attorney General told the Supreme Court
that the document which was published by the newspaper was stolen from the
Ministry of Defense. We are doing internal investigation of this. Justice KM
Joseph, while sternly commenting during the hearing, said that if the evidence
is strong and corruption has happened then the investigation must be done.
Government says Rafael's paper stolen
AG KK Venugopal has said that action should be taken against
the seized documents which have been printed by the newspaper. The attorney
general said that some documents were stolen from the Ministry of Defense and
they were further extended. He said that this case is very important. The
newspaper has made some confidential information public AG told the court that
government relations from other countries are outside the Act of RTI, but the
newspaper made all things public, which is a crime.
Prashant Bhushan, who filed a review petition at the
beginning of the hearing, showed the 8 page note to the court. However, the
court has said that he will not take any new evidence in this matter, the
things which are available to him will be the matter.
KK Venugopal said that if the judicial review is done on the
Rafael deal then the impact on future purchases may be affected. He said that
foreign companies will have to think about this. He explained that we have to
overcome the action of Parliament, Media and Court. He said that the court is
being influenced by the media.
He said that 22 pilots were going to France to take the
training of Raphael flying every month. But the whole process has stalled, this
has caused huge loss to the country. Venugopal said that the newspaper should
tell his source and should reject this petition as it is based on the pirated
documents.
'Corruption has happened, then inquiry will be done'
Justice KM Joseph made a big comment during the hearing. He
told KK Venugopal, are you saying that investigation of corruption should not
be just because the source is unconstitutional. We have to investigate the
evidence. They said that the evidences stolen are also important, it must be
investigated.
Chief Justice Ranjan Gogoi has asked the AG KK Venugopal
that if you think that Rafael's paper has been stolen and newspapers have
written articles on stolen papers, then why did the government not take any
action?
Sanjay Singh jerk
Aam Aadmi Party leader Sanjay Singh, who filed a
reconsideration petition in the Rafael case, was shocked by the Supreme Court.
During the hearing when his lawyer stood up for arguments, the Chief Justice
said that we will not listen to Sanjay Singh. He has made some comments which
are not right. Chief Justice has asked Sanjay Singh to appear before the court
in contempt of court.
On December 13, 2018, the Supreme Court had ruled in the
Rafael aircraft deal and said there was no mess in the deal. However, some
people had questioned that the central government did not present the right
papers in front of the Supreme Court, so the decision should be re-considered.
Shortly after the verdict, the Central Government had filed
an amendment petition. After this, Prashant Bhushan filed a petition and
demanded that action taken against the officials who mislead the court in the
notice given by the government. On February 26, the Supreme Court made it clear
that the decision on Rafael case will be re-considered in the open court.
Let us tell you that senior advocate Prashant Bhushan, BJP
rebel leader Yashwant Sinha, Arun Shourie, Aam Aadmi Party MP Sanjay Singh and
lawyer ML Sharma have appealed in the petition to review the Rafael order from
the court.
The appeal said that the government has not followed the
correct procedure for making purchases of Raphael fighters. The Modi government
has kept the news of 3P, the price, Procedure, Partner and kept an improper
advantage.
At the same time, in the appeal of the central government,
it has been said that the court should improve the remarks in its decision that
the CAG report refers to keeping Parliament in front. The Center says that the
court has misinterpreted the government note.
A petition of Prashant Bhushan, who seeks action against
officials who mislead the court in a note issued by the government. It was
written that the CAG submitted its report to Parliament on Raphael.
Let me tell you that Congress President Rahul Gandhi has
been surrounded by Prime Minister Narendra Modi on this issue. Rahul had a
press conference several times on this issue and said that PM Modi has messed
up Rafael Deal to benefit Anil Ambani.
